Welcome to Kapture! These Terms & Conditions outline the rules and regulations for the use of the Kapture mobile application and website, operated by Kapture Inc. By accessing Kapture, you agree to abide by these Terms. Please read them carefully before using the Service.

By accessing or using Kapture, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

Kapture reserves the right to update, modify, or replace these Terms at any time without prior notice. Your continued use of the Service after any such changes constitutes acceptance of the new Terms.

5. Content

5.1. Kapture allows users to create, upload, post, and share content, including but not limited to photos, videos, comments, and messages.

5.2. You retain ownership of the User Content you create and share on Kapture. However, by posting User Content, you grant Kapture a non-exclusive, royalty-free, worldwide, perpetual, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with the Service.

5.3. You are solely responsible for the User Content you post, and you represent and warrant that you have all necessary rights to grant the licenses described in these Terms.

6. Prohibited Conduct

6.1. You agree not to use Kapture for any unlawful purpose or in any way that violates these Terms.

6.2. Prohibited conduct includes, but is not limited to:

• Posting or transmitting any User Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, or otherwise objectionable.
• Impersonating any person or entity or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
• Engaging in any activity that disrupts, interferes with, or harms the Service or its users.

7. Intellectual Property Rights

7.1. All content, features, and functionality on Kapture, including but not limited to text, graphics, logos, images, and software, are the intellectual property of Kapture or its licensors and are protected by copyright, trademark, and other intellectual property laws.

7.2. You may not modify, reproduce, distribute, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on Kapture without the prior written consent of Kapture or the appropriate owner.

8. Termination

Kapture reserves the right to terminate or suspend your access to the Service at any time, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

9. Limitation of Liability

To the fullest extent permitted by law, in no event shall Kapture, its affiliates, or their respective directors, officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, arising out of or in connection with your use of the Service.

These Terms shall be governed by and construed in accordance with the laws of Jurisdiction, without regard to its conflict of law provisions.
